The honest answer in 2026 is: yes, for most use cases, on most of the major AI music apps — but the details matter, and the parts that do not work are very specific. This guide is the version I wish someone had written for me when I started covering this space: a practical, plain-language walk through what you can sell, what the apps' terms actually say, and the few specific patterns to avoid.

This is a guide, not legal advice. For a high-stakes release — a major commercial campaign, a TV sync, a label-distributed album — talk to an entertainment lawyer. For a Spotify upload or a YouTube monetization, the information below is more than enough.

The short answer

If you generated the song yourself, with your own prompts or lyrics or story, on a major AI music app with a paid commercial-use tier — yes, you can sell it. You can release it on Spotify and Apple Music, monetize the YouTube video that uses it, license it to clients, play it at events, or include it in a paid product.

The two main things that change this answer:

  • The app's tier. Most apps restrict commercial use to a paid tier. Free tiers usually allow personal/non-commercial use only.
  • Imitating a named real artist. Asking the model to "sound exactly like Drake" or to clone a specific singer's voice is the part of this landscape that is still legally hot, and the part to avoid.

If you stay on a paid tier and write prompts about styles, eras, instruments, and moods — not named real artists — selling AI music is mostly settled territory in 2026.

Who owns AI-generated music

The ownership picture for AI-generated music is best understood as three separate layers, because the law treats them differently:

The audio output you generated. This is what you actually want to sell — the recorded track. Under most current AI music app terms in 2026, this output belongs to you (the user) once you generate it on a paid tier. The app grants you the right to use, distribute, and monetize it. This is contractual ownership, granted by the app's terms of service, and it is the layer that matters most for practical commercial use.

Underlying copyright. This is the trickier layer. Most major streaming and distribution platforms now accept AI-generated music, but each has specific disclosure or tagging rules. As of mid-2026:

Spotify

Accepts AI-generated music with no special restriction on the music itself. Spotify has cracked down hard on fraudulent streaming of AI music (botted plays, mass-uploaded spammy catalogs designed to game royalty payouts), but legitimate AI music — uploaded by the actual creator, with normal listening behavior — is welcomed. TikTok

The risky territory — what to actually avoid

The legal landscape has settled enough that "selling AI music" is no longer the hard question. The hard question is the small set of specific things to avoid:

  • Cloning a named real artist's voice. Asking the model to "sing in the voice of [named artist]" is the highest-risk pattern in the entire category, both legally and platform-policy-wise. Most major apps now block named-artist voice clone requests in their prompt filters, and the ones that do not still expose you to right-of-publicity claims.
  • Prompts that explicitly imitate a named artist's style. "Write me a song that sounds exactly like Taylor Swift" is in a grayer zone — style is not copyrightable, but the more your output specifically resembles an identifiable artist, the more you invite scrutiny. Reference genres, eras, and instruments instead.
  • Using copyrighted lyrics. AI music apps generate new lyrics from your prompts.
